The office of the Trustee is a fiduciary office. As such, a Fiduciary is held to a high standard of duty and care. He or she owed a duty of loyalty to the beneficiaries named in the Trust document.
Trust administration need not involve the Court. However because of the high standard of duty and care expected of the Trustee, professional guidance is recommended for dealing with income and estate tax issues; administration options provided for in the Trust document and in state law; investment management decisions; interpreting vague Trust provisions; reforming Trust provisions that do not take full advantage of the ever changing law; and asset distribution and wind-down.
